Welcome to ExClarity (ex-clarity.com). These Terms of Service (“Terms”) govern your access to and use of the ExClarity website, AI-powered analysis tools, downloadable reports, and all related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Overview of the Service

ExClarity provides AI-powered psychological analysis of text messages in the context of interpersonal relationships. The Service includes:

• Free Decoder: Paste a text message and receive AI-generated emotional tags, a verdict, and an attachment-style teaser.
• Full Relationship Audit (paid): A comprehensive AI-generated psychological report covering subtext translation, attachment style prediction, power dynamics, tactical advice, psychological traps, and a healing message.
• High Self-Esteem Rewrite (Credits-based): AI rewrites your draft messages to project confidence and healthy boundaries.
• Share Cards & PDF Reports: Downloadable and shareable visual summaries of your analysis.

2. Not Medical or Professional Advice

ExClarity is an entertainment and educational tool. It is NOT a substitute for professional psychological counseling, therapy, psychiatric treatment, or medical advice.

• The AI-generated analyses are probabilistic interpretations based on language patterns. They do not constitute a clinical diagnosis.
• The “Dr. Clarity” persona is a fictional AI character, not a licensed professional.
• If you are experiencing a mental health crisis, domestic violence, or any form of abuse, please contact a licensed professional or emergency services immediately.
• You should not make significant life decisions (legal, financial, medical, or relational) based solely on ExClarity’s output.

3. Eligibility

You must be at least 18 years old to use the Service. By using ExClarity, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. User Accounts & Identity

ExClarity does not require account registration. Your identity is associated with the email address you provide at checkout. You are responsible for maintaining the confidentiality of your email and any associated access tokens stored in your browser. ExClarity is not liable for unauthorized access resulting from your failure to protect your credentials.

5. Payments, Pricing & Merchant of Record

5.1 Merchant of Record

All payments are processed by Lemon Squeezy (Lemon Squeezy, LLC), which acts as the Merchant of Record for all transactions. When you make a purchase, you are transacting with Lemon Squeezy, which handles payment processing, sales tax, VAT collection, and invoicing on behalf of ExClarity. Lemon Squeezy’s terms of service apply to all payment transactions.

5.2 Products & Pricing

• Full Relationship Audit: One-time purchase of $9.99 USD per analysis. Each purchase unlocks one specific analysis report permanently.
• Rewrite Credits: Available in packs of 5 ($2.99 USD) or 20 ($7.99 USD). Each credit enables one AI-powered message rewrite. Credits are non-expiring but non-transferable.
• Purchasing a Full Report includes 3 complimentary Rewrite Credits.

Prices are subject to change. Any price changes will not affect previously completed purchases.

5.3 Refund Policy

Because ExClarity delivers digital products that are generated and delivered instantly upon purchase:

• Full Reports: Refund requests may be submitted within 7 days of purchase if the report has not been viewed or downloaded. Once a report has been accessed, it is considered delivered and is generally non-refundable.
• Rewrite Credits: Unused credits may be refunded within 7 days of purchase. Partially used credit packs are non-refundable.
• Refunds are processed through Lemon Squeezy. To request a refund, contact us at [email protected] with your order email and reason for the request.
• We reserve the right to deny refund requests that indicate abuse of the refund policy.

6. Acceptable Use

You agree not to:

• Use the Service to harass, stalk, threaten, or harm any individual.
• Submit messages that you do not have the right to share (e.g., messages obtained through unauthorized access to another person’s device).
• Attempt to reverse-engineer, scrape, or automate access to the Service, including circumventing rate limits or human-verification measures.
• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Misrepresent ExClarity’s AI output as professional psychological, medical, or legal advice.
• Submit content that is illegal, harmful, or violates any third party’s rights.

Violation of these terms may result in immediate termination of your access without refund.

7. Intellectual Property

• The ExClarity brand, website design, AI prompts, report templates, and all original content are the intellectual property of ExClarity and are protected by applicable copyright and trademark laws.
• AI-generated reports and rewrites are provided for your personal, non-commercial use. You may share your own reports and share cards on social media.
• You retain ownership of the text messages you submit. By submitting a message, you grant ExClarity a limited, non-exclusive license to process it for the purpose of delivering the Service.

8. AI-Generated Content Disclaimer

• All analyses, reports, and rewrites are generated by third-party AI models (such as Google Gemini or OpenAI GPT). ExClarity does not guarantee the accuracy, completeness, or reliability of AI-generated content.
• AI outputs may contain errors, biases, or inappropriate interpretations. You use them at your own risk and discretion.
• ExClarity does not endorse or adopt any specific AI-generated statement as its own professional opinion.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXCLARITY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL EXCLARITY’S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO EXCLARITY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless ExClarity and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 2, 7, 8, 9, 10, and 13) will remain in effect.

12. Modifications to the Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the “Last Updated” date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
