These Terms of Service (“Terms”) govern your access to and use of the ExClarity website, AI-powered analysis tools, downloadable reports, and all related services (collectively, the “Service”). ExClarity provides AI-powered psychological analysis of text messages in the context of interpersonal relationships. The Service includes:
ExClarity is an entertainment and educational tool. It is NOT a substitute for professional psychological counseling, therapy, psychiatric treatment, or medical advice.
You must be at least 18 years old to use the Service. By using ExClarity, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
ExClarity does not require account registration. Your identity is associated with the email address you provide at checkout. You are responsible for maintaining the confidentiality of your email and any associated access tokens stored in your browser. ExClarity is not liable for unauthorized access resulting from your failure to protect your credentials.
All payments are processed by Lemon Squeezy (Lemon Squeezy, LLC), which acts as the Merchant of Record for all transactions. When you make a purchase, you are transacting with Lemon Squeezy, which handles payment processing, sales tax, VAT collection, and invoicing on behalf of ExClarity. Lemon Squeezy’s terms of service apply to all payment transactions.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXCLARITY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
IN NO EVENT SHALL EXCLARITY’S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO EXCLARITY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless ExClarity and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 2, 7, 8, 9, 10, and 13) will remain in effect.
We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the “Last Updated” date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
If any provision of these Terms is held to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
